New ADA Rules Mandatory - ARE YOU READY?
In case you need it, the information below will guide you to the regulations. We will follow up with additional insights in the weeks to come.
The new, revised regulations for Titles II and III of the Americans with Disabilities Act (ADA) including signage - first published in September 2010 -- become mandatory nationwide this Thursday, March 15, 2012.
Where, What, How
The rules for where ADA signs are required are covered in Chapter 2: Scoping Requirements within Article 216 beginning on page 71 of the 2010 ADA Standards for Accessible Design.
The rules for what is required for manufacturing and how signs should be installed begin on page 186 in Chapter 7: Communications Elements and Features, Article 703 of the 2010 Standards.
Title II - State and Government Facilities
Title III - Public Accommodations & Commercial Facilities
According to the Department of Justice (DOJ), the 2010 Standards set both scoping and technical minimum requirements for newly designed and constructed or altered buildings in these categories to be readily accessible to, and usable by, individuals with disabilities.
How does project timing affect this?
Under Title II the 2010 Standards are required on any physical construction or alterations subject to ADA rules that commence on or after March 15, 2012.
Under Title III the new standards apply if the date when the last application for a building permit or permit extension is either certified or received by the appropriate government jurisdiction (See actual rule for details.) on or after March 15, 2012 - or, where no permit is required, if the start of physical construction or alterations occurs on or after March 15, 2012.
